PRESS RELEASE
By its criminal decision no. 693 from June 7th 2012, the Court of Appeal Iași maintained the decision of the First Instance Court Vaslui which ruled as follows:
The conviction of the defendant MARIAN SERGIU, former Sub-Prefect of the County of Vaslui, to a punishment of 2 years imprisonment with conditioned suspension of the execution, to a probation period of 4 years, for having committed the following offences: material forgery of official documents under the form of indirect participation, use of forgery, committed through repeated acts, under the form of indirect participation (three material acts), attempt to abuse of office against the public interests in a qualified form, if the civil servant obtained a patrimonial or a non patrimonial advantage for himself or for another, under the form of indirect participation.
The court denied the defendant the following rights for three years after executing the main punishment: the right to be elected in public authorities or in public elective offices, to hold a position involving the exercise of the state authority and the right to hold a position or to exercise a profession or to carry out an activity of the same nature as the one the defendant used in order to commit the offence.
The conviction of the defendant LUCA GABRIELA, councilor within the Prefect’s Office of the County of Vaslui, to a punishment of 8 months imprisonment with conditioned suspension of the execution, to a probation period of 2 years and 8 months, for having committed the offences of: forgery of public documents, under the form of indirect participation, use of forgery committed through repeated acts, under the form of indirect participation (three material acts), attempt to abuse of office against the public interests in a qualified form, if the civil servant obtained a patrimonial or a non patrimonial advantage for himself or for another, committed through repeated acts, under the form of indirect participation.
The conviction of the defendant HUDUM MIHAI, civil servant within the State Domains Agency Vaslui, to a punishment of 8 months imprisonment with conditioned suspension of the execution, to a probation period of 2 years and 8 months, for having committed the offences of: forgery of public documents, under the form of indirect participation, attempt to abuse of office against the public interests in a qualified form, if the civil servant obtained a patrimonial or a non patrimonial advantage for himself or for another.
The court acknowledges the fact that the Station for Research – Development for Meadows and the State Domains Agency did not lodge an application as a civil party in the criminal proceedings.
The court orders the defendants Marian Sergiu, Luca Gabriela and Hudum Mihai to pay the amount of 2,016 lei each of them, as legal expenses to the state.

The defendants were sent to trial by the prosecutors of the National Anticorruption Directorate – the Territorial Service Iași on November 11th 2009 (press release no. 295/VIII/3 from November 17th 2009).
