PRESS RELEASE
By its criminal decision no. 470 from March 5th 2012, the Court of Appeal Bucharest ruled as follows:
The conviction of the defendant NECULA FIVI, sole associate and administrator of S.C. BAZALTUL S.R.L. Slatina to a punishment of 5 years imprisonment, for having committed the offence of instigation to using or presenting false, inexact or incomplete statements, which has as a result the undue obtaining of European funds, with extremely serious consequences, committed through repeated acts.
The court denied the defendant the following rights for the period of executing the punishment and for ten years after that: the right to be elected in public authorities or in public elective offices, to hold a position involving the exercise of the state authority and the right to hold a position or to exercise a profession or to carry out an activity of the same nature as the one the defendant used in order to commit the offence.
The court orders the defendant together with the civilly accountable party S.C. BAZALTUL S.R.L., to pay the sum of 321,978 lei, as civil damages to the civil party, the Payment Agency for Rural Development and Fishery.
The court maintains the measure of seizing the movable and immovable assets belonging to the civilly accountable party, up to the equivalent of the amount of 321,978 lei.
The court orders the defendant to pay the sum of 300 lei as procedural expenses to the state.
FINAL
The defendant was sent to trial by the National Anticorruption Directorate on March 26th 2008 (press release no. 63/VIII/3 from April 1st 2008).
